White Pages: Point by Point
This is my union causing my family and me more grief by posting their unethical decision process for my medical claim on their web site. I am currently receiving social security disability but I don't qualify for disability from the NFL. I have had 7 spine surgeries and 4 disc's fused on my spine and 4 screws in my lower back. I fall asleep during the day and have vertigo. My social security disability report from Kathie Morton, Ph.D. 9/9/2004 states that I have head injuries and have suffered strokes from numerous concussions. However, the NFL is still doing studies on concussions because they are not sure? Not sure of what? Read my report. Delay, Deny, and hope they die. Plus, I need a total left hip replacement. Also, the 4 screws in my spine will need to be removed once the fusion is solid. Then, I am told that my right hip is not much better than my left and I will need a right hip replacement in the near future. The deceitful, cruel and evil disability process has caused a hardship for my family since 1983 when I was denied my valid medical claim for disability. The NFLPA is attempting to justify their shameful decision process. Their system is designed to deny valid medical claims and then rub your nose in it by beating down disabled retired football players and their families by not paying their medical bills. I personally have spent over $500,000 of my own money on medical bills since the NFL has turned their back on my family starting in 1981.

1) The White Pages: "Mr. Pear played professional football in he NFL from 1975-1980"
This is TRUE.
2) The White Pages: :"The retirement board denied Mr. Pears 1983 claim for LOD benefits based on an arbitration decision finding that Mr. Pear did not meet the requirements for these benefits in effect when he applied".
This is FALSE! This is also an ABUSE of power! This shows how the process is RIGGED!
I was denied the benefit. However, I did meet the requirements but the arbitrator abused and misused his power. When I was released from the Raiders in 1981 I went to the Stanford medical center on my own and the Dean of neurosurgery drilled a herniated disc out of my neck. (see my medical report dated 12/5/81 by Dr. Hanbery). My football career was over. In 1983 the NFLPA sent me to see their doctor, Dr. Becker. Dr. Becker rates my disability to be 50%-59%, a football related injury and I will not be able to play football again. (see my physicians report 5/2/83). I met the percentage of disability, it was a football related injury and I will not be able to return to playing football writes the NFL doctor. This is the plan requirement. But, the plan also gives the arbitrator the power to deny any valid medical claim he or she chooses? My claim was valid and I qualified but the arbitrators decision is final. This is GROSSLY unfair and unethical? The disability system is rigged and set up to deny valid medical claims. I ask, who was the arbitrator? He has the power to deny valid medical claims but is he qualified in the medical field? What did he base his decision on? Who pays his salary? This has caused a hardship for my family. The NFL owes my family disability benefits starting in 1983. I WOULD LIKE ALL THE MINUTES OF MY DISABILITY DENIAL FROM EVERYONE INVOLVED! In 1984, I had my neck fused. (see medical report 5/17/84). The arbitrator abused his power and hurt my family. Shame on you! How would you feel if someone hurt your family the way you hurt mine? You denied us our medical benefits. My union stood by and did NOTHING and now they are attempting to justify their deceitful actions on this web site. Shame on you! I was wrongly denied my benefit

4) White Pages: "At that time, the retirement board was required to determine that the players injury caused him to leave football before it could grant LOD benefits".
I had a neck operation and was not able to play football anymore. Read all my doctor's reports and the NFL doctor's report that I was sent to for an examination prior to your decision. I WOULD LIKE THE MINUTES TO ALL THE MEETINGS IN DECIDING MY DENIAL?
5) White Pages:"After evaluating the report of the neutral physician who examined Mr. Pear the three player trustees wanted to award Mr. Pear the LOD, but the three management trustees refused to do so".
This is the problem. The three management trustees REFUSED to do so. What valid reason did they have for refusing my family my medical benefits? Every doctor's report validates my claim? This is how management treats disabled players that help make the league what it is today. Once you are injured they toss you and your family away. I WOULD LIKE THE MINUTES OF THAT MEETING. Who were the three management trustees? What are their qualifications for making medical decisions? Other that having the power to deny valid medical claims, what was their reason? The three management trustees abused and missed used their power and created a hardship for my family starting 1n 1983 and it continues today. This is wrong. They owe my family medical benefits starting in 1983 when they cheated my wife and children out of a dad and I had to spend over $500,000 of my own money on medical care from injuries I received playing football in the NFL.
6) White Pages: "As a result of this dead lock, the board sent the issue to arbitration, who ultimately ruled that the injury did not cause Mr. Pear to leave football".
This is a BIG FAT LIE! A BIG FAT LIE! Why else would I leave football? Football was my life. Read my medical reports on my injury. Who is the arbitrator? Is he qualified to make medical decisions that can effect a whole family? I never even met this monster. He abused and miss used his power. How would he like someone to treat his family this way? You are a thief and a scoundrel! The disability process is deceitful, cruel and evil. This arbitrator shows why. The system is rigged. This is why so many disabled players are screaming, STOP CHEATING OUR FAMILIES OUT OF OUR VALID MEDICAL CLAIMS. I WANT THE MINUTES TO THIS BACK ROOM DECISION. You should be more than ashamed of yourself but you have no shame.
7) White Pages: "AS a result of the NFLPA's successful negotiation bargaining, this requirement for the LOD benefits, that the injury must have made the player leave the game was dropped from the plan after the 1993 CBA".
This is how the NFL traps disabled played that made them SO much money. When I injured my neck in 1979 I did leave the game. I came out that play only to be drugged with pills and shots from the trainer and doctor and sent back in. The Raiders pressured me to play hurt. They never acknowledged my injury or gave me a physical. How cruel it is to give injured players shots and pills to cover over the pain and pressure them to play. If you treat animals this way, (dogs) it is a crime but this is how the NFL is allowed to treat human beings with families. For the NFL it is OK. How can the NFL discipline players for cruelty to animals when they treat human beings the same way and are not held accountable?
8) White Pages: "The retirement board denied Mr. Pear's 1995 claim for T&P benefits because the board determined that he could work after evaluating the medical evidence in the file".
Did the retirement board read what their own doctor wrote after my examination by Dr. Ungher dated 9/11/1995 that reads, "From my examination, this patient is markedly incapacitated from both the cervical and lumbar areas, all of which were secondary to injuries sustained while playing professional football". " I would only permit this patient to perform sedentary work, with no bending, no lifting greater than #15. MUST BE ABLE TO REST FREQUENTLY". I was never able to find a job that would allow me to rest frequently. what job would the retirement board recommend for me? Would you hire me? Who is an occupational therapist or qualified to make this decision? Who is on this retirement board? I WOULD LIKE THE MINUTES OF THIS MEETING. It seems that the word "sedentary" is used by many NFL doctors that evaluate disabled players. What type of sedentary job are you talking about? You see I fall asleep during the day, I also have vertigo and chronic pain and memory problems from repeated concussions. Please be specific, what job do you recommend? Social security has rated me permanently and totally disabled but not the NFL. The NFL disability process is designed to deny valid medical claims and create hardships for families. I made a choice to play football but my family didn't. They have to suffer because you won't honor valid medical claims! Shame on you. How would you like to be treated this way?

Doing what? What specific job does he recommend? No job exists like this. Is DR. Unger and occupational therapist and qualified to make statements like he did? The NFL disability process is designed to deny valid medical claims.

I did apply and I was wrongly denied.
